We are living in a climate where the world indulges in class action suits for all kinds of concerns. And why not? What seems like a low cost court case to one individual is big bucks for the legal eagles who receive the same amount timesed by the number in your class action suit.

One of the most popular class action suits to have been rearing its ugly head of late is the class action suit against timeshare companies. “What’s so bad about that?” you might ask! Well, the scam here is that many of the timeshare companies (like the Villa Group, Marriott, even Disney!) that are being taken to court by the scam class action suits are actually genuine timeshare companies. What this means is that the client will have no chance of winning the class action case because the timeshare is not a scam.  Obviously, clients do not realize this until a long time after they have handed over their money.

Not all class actions are bad. A class action suit is a great solution for large groups of people who need to sue a company or individual who has breached a contract or caused fraud deliberately. For example, a class action suit would be great for medical fraud and negligence or to sue a pyramid scheme. However, you can only benefit from a class action suit if you have had your contract breached according to the law or had fraud committed on you.

How does the Class Action Timeshare Scam work?

Lawyers and agents working for class action timeshare companies encourage innocent people who are not happy with their timeshare membership or who can no longer afford to keep up their payments to join a class action suit against their timeshare company. In most cases, the timeshare company is a legitimate company which has not breached its contract, and therefore the class action fails but the lawyers keep your money, knowing full well that you did not stand a chance of winning.

The same is true for Villa Group scams. To file a class action suit against a timeshare company like the Villa Group, you must have a true and solid case. However, as this is a legitimate timeshare provider, it is highly unlikely that your case is sufficient. More than likely, you concerns can be solved directly with the company when you learn how to use your membership correctly.  However, despite this, you will find a number of bogus companies who will offer to provide you with assistance in suing Villa Group scams in class action suits, but these companies know firsthand that the class action suits will not win, but they don’t care if the case wins, because they are charging each person with a large sum of money anyway.

Pros and Cons of Class Action Suits

It is affordable for a group of people to file a class action suit, but you must remember that if your case fails, then you can’t just file another suit alone. Your case is over. Will you receive the damages that you want and is it worth the costs that you have paid?
